Terms of Service

The short version. Red Biscuit is an app for two people. What you write is yours. Coins and energy are game tokens: not money, and not exchangeable for money. Section 6 sets out what use is not allowed and section 11 how far our liability goes.

1. Who we are and what you are accepting

Red Biscuit is an application developed by Vestta Studios (Argentina). By creating an account you accept these Terms and the Privacy Policy. If you do not agree, do not use the app.

2. Minimum age

You must be 16 or older to use Red Biscuit. By creating an account you confirm that you are.

3. Your account

You are responsible for your account's activity and for keeping your credentials safe.
An account belongs to one person. Do not share it.
You can delete it at any time from More → Settings → Delete my account.

4. Pairing

Red Biscuit connects exactly two accounts through a code. Once paired, the other person can see your name, your photo, your status, the content you share and how far apart you are if you enabled that permission. Only pair with someone you trust.

5. The content you upload

The content is yours. We claim no ownership over what you write or the photos you upload.
You grant us a limited, non-exclusive, royalty-free licence solely to host, process and display that content inside the app — what is technically required to store a letter and show it to your partner. The licence ends when the content is deleted.
You confirm you have the right to upload what you upload, and consent from anyone appearing in your photos.
We do not systematically review content. We may remove content and suspend accounts where these Terms are breached or the law requires it.

6. Acceptable use

You may not use Red Biscuit to harass, threaten or impersonate anyone; to upload illegal content, child sexual content, or content infringing third-party rights; to attempt to access other people's accounts; to automate use, reverse engineer or circumvent the service's technical limits; or to obtain advantages in the game economy by unintended means.

7. Coins, energy and companions

Coins, energy, levels and companions are virtual in-game items. They are not money, have no value outside the app, cannot be exchanged for money and are not transferable.
You can earn them by playing. If they become purchasable in future, the purchase is governed by the store's terms at the time of payment.
The daily capsule machine awards random prizes. The real odds are published inside that screen under "Ver probabilidades", and are exactly the ones the server rolls with.
We may adjust the game economy (prices, odds, daily limits) to keep it balanced. Balances you already hold are not reduced by such an adjustment.
If you delete your account you lose your balances and virtual items with no right to compensation.

8. Premium subscription

Premium is an auto-renewing subscription. Billing, renewal and cancellation are handled by the store you bought it from (Google Play or the App Store) under their own terms.
Premium belongs to the couple: one person pays and both have it while they are paired. If the link is dissolved, the benefit stays with whoever pays.
To cancel, use your store's subscription settings. Uninstalling the app cancels nothing.
Refunds are decided by the store under its policy.

9. Advertising

Red Biscuit may offer rewarded ads: you watch an ad and receive energy. Watching is always optional.

10. Service availability

We work to keep Red Biscuit running well, but it is provided "as is". We do not warrant that it will be uninterrupted or error-free. We may modify, suspend or discontinue features; if we discontinued the service entirely, we would give reasonable notice so you can retrieve your content.

Keep your own copies of anything that matters to you. We are not a backup service.

11. Liability

To the maximum extent permitted by applicable law, we are not liable for indirect damages, lost profits or data loss arising from use of the app. Nothing here limits rights granted to you by consumer protection law that cannot be waived.

12. Suspension and termination

We may suspend or close an account that breaches these Terms or endangers another user or the service. Where reasonable, we give notice first.

13. Changes

If we change these Terms materially we raise the version number and the app asks you to accept them before you carry on.

14. Governing law

These Terms are governed by the laws of the Argentine Republic. Any dispute is submitted to the competent courts of the City of Buenos Aires, without prejudice to any venue required by consumer protection rules.
